A situation I learned of last week. Big D will probably chime in, I believe he knows more about than me.
Lady club member and participant at a car club event is hit by a car belong to another participant.
At this time I don't know any other details such as what were the precipitating events or how badly she was injured. This was not my Mustang club.
However, her husband had filed suit against:
1) the car club
2) all members of the car club
3) all sponsors of the club and the event.The club isn't even a legal entity. Members have already paid $1400 to retain legal counsel for the club - this does not include individual representation.
MCA provides insurance for Regional Mustang club shows for a one day static car show. The club and its members are not covered for each and every event. I've asked a MCA board member to investigate possibility of obtaining broader coverage. When you register for a show, you sign a release of liability but that does not mean some one else couldn't sue YOU!
This is all aside of the person who hit the woman who may or may not be at fault, depending on the situation.
There are so many time when a group of friends get together and cruise or hang-out. Will we have to sign a waiver everytime?
The impact of such a suit on our hobby could be huge. Businesses wouldn't want to sponsor if they could be liable.
Hopefully, this will get thrown out as frivolous. But in the meantime everyone has to hire a lawyer, take time off work for court appts etc., and worry.
